Information for Federal Contractors
Federal contractors and sub-contractors are required to use the U.S.Citizenship and Immigration Services E-Verify System starting Jan. 15, 2009, to verify their employees’ eligibility to legally work in the United States. The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council amended the Federal Acquisition Regulation (FAR) to reflect this change. The new rule implements Executive Order 12989 to use E-Verify to confirm the employment eligibility of federal contractors’ employees who perform contract services for the federal government within the United States.
Challenges of the E-Verify Program
The E-Verify Program provides an excellent interface for performing cross checks of Social Security Numbers with the government database and the Department of Homeland Security. However, management of the data, reproduction of reports for audits, electronic storage of documents, pre-set reminders for expiring documents, automatic notification of document expiration, and step-by-step instructions for filling out the form are not included with the system.
The bulk of errors that occur with the employment eligibility process are a result of difficulties involved with documentation management.
Automated Compliance Solutions
Not every company is prepared to take on the task or dedicate staff members to maintain an employment eligibility program that will ensure full compliance for both federal contractors and their sub-contractors. Many companies have chosen to use the Safe Sub-Contractor Program to limit the possibility of violating compliance regulations.
